امتياز توزيع الكهرباء والغاز حق تمنحه الدولة لشخص طبيعي أو معنوي استغلال وتوزيع هذه الخدمات لفترة زمنية محددة، عبر الإعلان عن المنافسة، وهو ذو طبيعة تنظيمية وتعاقدية، ويترتب عن هذا الامتياز التزامات وحقوق الأطراف المعنية بالالتزام ولصاحب الامتياز مكانة هامة فهو يقدم خدمات للمنتفعين وفق مبادئ المرفق العام مقابل مالي يتقاضاه، ويخضع لرقابة الهيئات التقليدية ولجنة ضبط الكهرباء والغاز وفي حال خروجه عن بنود دفتر الشروط ينتهي الامتياز نهاية عادية أو غير عادية ليتم تسوية النزاع وتصفية أملاك الامتياز، كما يشكل هذا النظام أداة قانونية تهدف إلى تحقيق التوازن بين حماية المرفق العام وتحقيق النجاعة الاقتصادية وتحديث البنية التحتية للطاقة.

It is by nature regulatory and contractor. This concession entails obligations on the concerned parties to comply with regulatory and contractual provisions. As such, the concession reflects a public utility service provided to beneficiaries in exchange for financial compensation. The concession holds significant value, as it concerns the concerns the provision of public utility services. It is subject to the oversight of regulatory bodies and a technical committee responsible for monitoring electricity and gas distribution. in the event of breach of the terms, the concession may be. terminated unilaterally by the grantor. In the case of its expiration or termination, a specific legal mechanism is adopted to ensure the transfer of assets from the concessionaire to the public entity. This legal framework aims to achieve a balance between protecting public utilities realizing economic efficiency, and promoting energy sustainability.
