Résumé:
تشكل جرائم التجارة الإلكترونية تهديدا كبيرا على مجال التجارة الإلكترونية، كونها من الجرائم المستحدثة والتي تتميز بالتطور المستمر خاصة في ظل التقدم الهائل الذي تشهده تكنولوجيات الإعلام والاتصال، مما أدى إلى خلق تحديات كبيرة أمام المشرع الجزائري نظرا للإشكالات العديدة التي تطرحها هذه الجرائم، إلا أنه بالرغم من ذلك يحاول بشتى الطرق والوسائل مكافحتها والتصدي لها، وذلك حماية للاقتصاد الوطني والمجتمع من تأثيرها.
فقد حدد المشرع من خلال التنظيم الخاص بالتجارة الإلكترونية الالتزامات التي يتوجب على المورد الإلكتروني والمستهلك الإلكتروني على حد سواء الالتزام بها وتجنب مخالفتها، إذ أن أي إخلال بأحد الالتزامات الواردة في قانون التجارة الإلكترونية يعرض صاحبها لغرامات مالية.
Abstract:
E -commerce crimes pose a major threat to the field of e -commerce; Being one of the created crimes that are characterized by the continuous development, especially in light of the tremendous progress witnessed by media and communication technologies, which led to the creation of major challenges for the Algerian legislator due to the many problems posed by these crimes, but despite this he tries in various ways and means to control and address them, and that protects the national economy and society from its effects.
The legislator, through the regulation of e -commerce, has identified the obligations that the electronic resource and the electronic consumer alike must adhere to it and avoid violating it, as any violation of one of the obligations contained in the e-commerce law exposes its owner to financial fines.
