Résumé:
إذا كان استقلال الجماعات المحلية في ممارسة اختصاصاتها يُعد أحد أركان ومقومات اللامركزية الإقليمية، فإن ذلك لا يعني الاستقلال المطلق، وإنما تمارس السلطة المركزية رقابتها بهدف حماية وحدة الدولة إداريًا وقانونيًا، وضمان التزام الهيئات المحلية بجميع القوانين والأنظمة والتعليمات أثناء ممارسة نشاطها، وحماية حقوق الأفراد من الانحراف في استعمال السلطة، ومعالجة الأخطاء وأسبابها والعمل على تصحيحها.ويُستحسن التخفيف من حدة الرقابة الإدارية تفاديًا لهيمنة الوالي، وذلك بغرض تفعيل دور المجلس الشعبي البلدي للقيام بالمهام المنوطة به، وفي مقدمتها الإسهام في التنمية وتلبية الحاجات العامة للمواطنين، بدل الاقتصار على الدور التقليدي المتمثل في تقديم الخدمات العمومية كالإنارة والنظافة.
إن ضعف تسيير وأداء الجماعات المحلية يمكن إصلاحه من خلال إعادة النظر في التنظيم الإداري، ومراجعة نمط الانتخابات بما يضمن الكفاءة والشفافية، بعيدًا عن الجهوية الضيقة، إضافة إلى تكوين المنتخبين وتحسين أجورهم بما يتناسب مع حجم المهام الملقاة على عاتقهم. ويُضاف إلى ذلك ضرورة دعم تمويل الجماعات المحلية عبر تقوية الجباية المحلية.
كما يجب إرساء نظام انتخابي يضمن تمثيل الأقليات السياسية داخل المجالس المحلية، بما يحقق الديمقراطية المحلية ويفعل دور المجالس المنتخبة.
وتخضع الهيئة اللامركزية لنوعين من الرقابة تمارسها السلطة المركزية، وهما:
-الرقابة المشددة، كما هو الحال في رقابة الوزير على الوالي والمصالح الخارجية.
-الرقابة المرنة، التي تُطبق على المجالس المنتخبة، لا سيما على مداولاتها.
وإذا كانت المجالس المنتخبة تؤدي دورًا شكليًا أو صوريا بصلاحيات منقوصة بسبب الوصاية المشددة، فإن قراراتها غالبًا لا تُنفذ، وهو ما يحد من فعاليتها ويقلص من دورها. لذا، لا بد من تفعيل الرقابة السياسية من خلال دور الأحزاب في اختيار المنتخبين المحليين، وتكوينهم، ومتابعتهم، مع ضرورة تزويد الجماعات المحلية بالوسائل البشرية والمادية اللازمة لتسيير راشد وعصري. كما ينبغي تعزيز الرقابة التقنية عبر المفتشية العامة للمالية ومجلس المحاسبة.
Abstract:
If the independence of local communities in exercising their competencies is considered one of the pillars and foundations of regional decentralization, this does not mean absolute independence. Rather, the central authority exercises its oversight with the aim of protecting the administrative and legal unity of the state, ensuring the commitment of local bodies to all laws, regulations, and instructions while carrying out their activities, protecting individual rights from abuse of power, and addressing errors and their causes and working to correct them. It is preferable to reduce the intensity of administrative oversight to avoid the dominance of the governor, with the aim of activating the role of the Popular Municipal Assembly to carry out its assigned tasks, foremost among which is contributing to development and meeting the general needs of citizens, instead of being limited to the traditional role of providing public services such as lighting and sanitation.
The weakness in the management and performance of local communities can be remedied by reconsidering administrative organization, reviewing the electoral system to ensure efficiency and transparency, away from narrow regionalism, in addition to training elected officials and improving their salaries in proportion to the magnitude of the tasks entrusted to them. In addition, it is necessary to support the financing of local communities by strengthening local taxation.
An electoral system must also be established that ensures the representation of political minorities within local councils, thereby achieving local democracy and activating the role of elected councils.
The decentralized body is subject to two types of oversight exercised by the central authority:
- Strict oversight, as is the case with the minister's oversight of the governor and external services.
- Flexible oversight, which applies to elected councils, especially regarding their deliberations.
If elected councils play a formal or symbolic role with diminished powers due to strict guardianship, their decisions are often not implemented, which limits their effectiveness and reduces their role. Therefore, political oversight must be activated through the role of parties in selecting, training, and monitoring local elected officials, with the necessity of providing local communities with the necessary human and material resources for sound and modern management. Technical oversight should also be strengthened through the General Inspectorate of Finance and the Court of Accounts.
