Résumé:
تُعد المجالس المحلية المنتخبة أحد المظاهر الأساسية لتجسيد مبدأ اللامركزية الإدارية، حيث خول لها المشرّع الجزائري جملة من الصلاحيات القانونية والإدارية تمكّنها من تسيير الشأن العام المحلي والمساهمة في تحقيق التنمية الشاملة. وقد تم تأطير هذه الصلاحيات من خلال قوانين عديدة خولت للمجالس المحلية المنتخبة صلاحيات معتبرة في مجالات مختلفة منها تسيير الموارد والمرافق العمومية، المحافظة على الأملاك المحلية، وضمان تقديم الخدمات للمواطنين.
غير أن واقع الممارسة كشف عن ضعف فعالية هذه الصلاحيات، نتيجة عدة تحديات متداخلة تعيق المجالس المنتخبة من أداء دورها التنموي، من بينها ضعف الإمكانيات المالية والبشرية، محدودية الاستقلالية الإدارية بسبب استمرار نظام الوصاية، التعقيدات التنظيمية، بالإضافة إلى ضعف التنسيق بين مختلف الفاعلين المحليين، وانتشار الفساد، وتحديات أخرى شكلت عائقا أمام فعالية ممارسة المجالس المحلية المنتخبة لصلاحياتها.
وأمام هذه التحديات، تبرز الحاجة الملحة إلى تفعيل آليات إصلاح شاملة تشمل مختلف الميادين: التنظيمية، المالية، الإدارية، والسياسية، من أجل تمكين المجالس المحلية المنتخبة من أداء مهامها بفعالية أكبر، وتحقيق الأهداف المرجوة من اللامركزية، وفي مقدمتها تنمية محلية متوازنة ومستدامة تُعبر فعليًا عن حاجيات السكان المحليين وتطلعاتهم.
Summary of the Study:
Elected local councils are considered one of the fundamental manifestations of the principle of administrative decentralization. The Algerian legislator has entrusted them with a set of legal and administrative powers that enable them to manage local public affairs and contribute to achieving comprehensive development. These powers have been framed by various laws that grant elected local councils significant authority in several areas, including the management of resources and public facilities, the preservation of local property, and the provision of services to citizens.
However, the reality of practice has revealed the limited effectiveness of these powers due to several overlapping challenges that hinder elected councils from fulfilling their developmental role. Among these challenges are weak financial and human resources, limited administrative autonomy due to the persistence of the guardianship system, organizational complexities, poor coordination between local actors, widespread corruption, and other obstacles that have affected the effective exercise of powers by elected local councils.
In light of these challenges, there is an urgent need to activate comprehensive reform mechanisms covering various fields—organizational, financial, administrative, and political—in order to enable elected local councils to perform their duties more effectively and to achieve the desired objectives of decentralization, foremost among them being balanced and sustainable local development that genuinely reflects the needs and aspirations of the local population
