Abstract

الملخص:شكالیة تتمثل فيٕیتناول هذا البحث مبدأ التناسب في القانون الدولي الإنساني وا:ما هي المكانة التي یحتلها مبدأ التناسب في القانون الدولي الإنساني؟.من أجل دراسة هذا الموضوع تم تقسیمه إلى فصلین:الفصل الأول:ماهیة مبدأ التناسب في القانون الدولي الإنساني.الفصل الثاني:تطبیقمبدأ التناسب في النزاعات المسلحة )الحرب اللبنانیة الإسرائیلیة 2006 -العدوان الإسرائیلي على غزة 2008(.من بین أهم ما تم التوصل إلیه :هو أن مبدأ التناسب یسعى إلى تحقیق التوازن ما بین الضر ورة العسكریة و الاعتبارات الإنسانیة، في ظل هاذین المصلحتین المتعارضتین، تكون الضرورة العسكریة حالة استثنائیة، تتم وفق شروط محددة وضوابط معینة من شأنها أن توفر حمایة كافیة للسكان المدنیین من الأعمال العسكریة.AbstractThe present research seeks the principal of proportionality in international humanitarian law, this attempt is investigated through the forthcoming question :What is the position of the principal of proportionality In international law?.The study is divided in twofold; chapter one deals.
